JOSE TAMEZCANO, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 283rd Judicial District Court Dallas County, Texas, Trial Court Cause No. F19-76346-T.

ORDER

NANCY KENNEDY JUSTICE

We REINSTATE this appeal.

On March 5, 2024, we abated this appeal for the trial court to make findings and recommendations concerning court reporter Norma Rico's failure to file the exhibits from the February 10, 2023 punishment hearing. On March 6, 2024, Ms. Rico filed the exhibits associated with that hearing. Accordingly, we VACATE the order of March 5, 2024, and the trial court need not hold the hearing or make the findings required by that order.

On February 13, 2024, we ordered that Ms. Rico not sit as a court reporter until she filed the complete reporter's record for the portion of the reporter's record assigned to her. She completed filing the reporter's record on March 6, 2024. Accordingly, we VACATE the order of February 13, 2024, to the extent that it orders Ms. Rico not to sit as a court reporter.

We DIRECT the Clerk to send copies of this order to the Honorable Lela D. Mays, Presiding Judge, 283rd Judicial District Court; Felicia Pitre, Dallas County District Clerk; Sharina Fowler, Official Court Reporter, 283rd Judicial District Court; Debi Harris, Deputy Official Court Reporter, 283rd Judicial District Court; Norma Rico, Deputy Court Reporter; Dallas County Auditor's Office; and counsel for all parties.
