We REINSTATE this appeal.
On January 4, 2024, this Court ordered court reporter Sharina Fowler not to sit until she filed the complete reporter's record in this case. We also abated the appeal and ordered the trial court to hold a hearing and make findings concerning the reporter's record.
On January 5, 2024, court reporter Debi Harris informed this Court that there were four court reporters on this case and that Ms. Fowler had completed her portion of the reporter's record. Ms. Harris also informed us that requests for extension using the wrong name and cause number had been filed.
On January 8, 2024, this Court issued an order vacating the order that Ms. Fowler may not sit. Later that day, this Court's case management system crashed, and some orders, including the January 8, 2024 order in this case, were not recovered. In the interest of the completeness of the Court's records, the Court issues the following order, which is similar in substance to the order of January 8, 2024, and effective as of January 8, 2024.
Accordingly, we VACATE the order of January 4, 2024, Ms. Fowler may sit as a court reporter, and the trial court need not hold the hearing required by the order of January 4, 2023.
Ms. Harris also requests an extension of time to file the reporter's record to enable her to obtain the record from the court reporter who has not yet submitted her portion of the reporter's record. We GRANT the request for extension, and we ORDER the reporter's record due FEBRUARY 9, 2024.
We DIRECT the Clerk to send copies of this order to the Honorable Lela D. Mays, Presiding Judge, 283rd Judicial District Court; Sharina Fowler, Official Court Reporter, 283rd Judicial District Court; Debi Harris, Deputy Reporter, 283rd Judicial District Court; Dallas County Auditor's Office; Christina O'Neil, Chief Judicial Staff Counsel for the Criminal District Courts, Dallas County; and counsel for all parties.
