TAM MEDICAL SUPPLY CORP. as Assignee of Colin Hull, Appellant, v. OMNI INDEMNITY COMPANY, Respondent.

Opinion

Appeal from an order of the Civil Court of the City of New York, Queens County (Ulysses Bernard Leverett, J.), entered January 30, 2014. The order, insofar as appealed from, upon, in effect, renewal, adhered to a prior determination of the same court dated September 26, 2013 granting defendant's motion for summary judgment dismissing the complaint.

For the reasons stated in Tam Med. Supply Corp. as Assignee of Woldine Destin v. Omni Indem. Co. (––– Misc.3d ––––, 2015 N.Y. Slip Op –––– [appeal No.2014–419 Q C], decided herewith), the order, insofar as appealed from, is affirmed.

PESCE, P.J., WESTON and SOLOMON, JJ., concur.
