Willie Talton v. The State of Texas

Trial court: 482nd District Court of Harris County, Trial court case number: 1832102

Panel consists of Hightower and Rivas-Molloy Justices.

The Honorable April L. Farris, former Justice of this Court, was a member of the Panel and participated in the decision/dismissal of the appeal. Her term of office expired on August 31, 2024, and she did not participate in the decision of the instant motion to expedite the mandate.

ORDER

Veronica Rivas-Molloy, Judge.

On August 1, 2024, the Court granted appellant Willie Talton's motion to dismiss and dismissed his appeal. See Tex. R. App. P. 42.2(a) (authorizing appellate court to dismiss appeal on appellant's motion prior to decision). Appellant has now filed an "Unopposed Motion For Immediate Mandate" requesting "this Court to issue the mandate immediately" and explaining that Appellant was informed by Harris County Jail that he "would not be released without posting an appeal bond since the case was still on appeal." See Tex. R. App. P. 18.1(c) (authorizing court to issue mandate early "if the parties so agree, or for good cause on the motion of a party").

The Court grants the motion. We direct the Clerk of this Court to issue the mandate immediately. See Tex. R. App. P. 18.1(c).

It is so ORDERED.
