Civil Action No. 3:04-CV-237-L
April 13, 2004
ORDER
This is a pro se civil rights case. Pursuant to 28 U.S.C. § 636(b), and an order of the court in implementation thereof, this action was referred to the United States magistrate judge for proposed findings and recommendation. On March 22, 2004, the Findings, Conclusions and Recommendation of the United States Magistrate Judge were filed, to which no objections were filed.
Plaintiff filed three documents on March 30, 2004, April 2, 2004 and April 7, 2004, in which he complained about the treatment he allegedly has received while in custody; he also filed another Complaint on April 5, 2004. The court does not consider or treat these documents as objections.
The magistrate judge recommended that Plaintiff's complaint be dismissed for want of prosecution. Specifically, the magistrate judge issued a deficiency order on February 11, 2004 notifying Plaintiff that his request to proceed in forma pauperis did not include a certified statement of the balance in his inmate trust account for the six-month period preceding the filing of the complaint and ordering him to correct the deficiency within thirty days. Plaintiff has failed to comply with the deficiency order. Having reviewed the pleadings, file and record in this case, and the findings and conclusions of the magistrate judge, the court determines that the findings and conclusions are correct. The magistrate judge's findings and conclusions are accepted as those of the court. Accordingly, Plaintiff's complaint is dismissed without prejudice for want of prosecution.
