Talbot v. Gill

Supreme Court of Louisiana
Jul 17, 2007
959 So. 2d 893 (La. 2007)

Opinion

No. 2007-CC-1492.

July 17, 2007.

In re Talbot, Theresa; — Plaintiff; Applying for Supervisory and/or Remedial Writs, Parish of Jefferson, 24th Judicial District Court Div. A, No. 640-864; to the Court of Appeal, Fifth Circuit, No. 07-C-189.

Writ denied. Stay denied.

CALOGERO, C.J., concurs in the denial of the writ application and assigns reasons. While the court of appeal may have properly vacated the district court's judgment, I believe the court of appeal acted prematurely in opining that the language of the lease contemplates only a one-time renewal. The issue of the lease renewal is better left for a determination by the court hearing the eviction proceedings.
