PRESENT:

Petitioner-respondent having moved for permission to proceed as a poor person and for assignment of counsel on the appeal taken herein from an order of the Family Court, Herkimer County, entered in the Office of the Clerk of said Court on July 22, 2016,

Now, upon reading and filing the affidavit of Justin S. Talbot, sworn to October 4, 2017, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted, and

It is further ORDERED that John J. Raspante, Esq., 209 Elizabeth Street, Suite 404, Utica, New York 13501-2230, is hereby assigned as counsel for petitioner-respondent herein and may submit ten copies of respondent's brief reproduced in accordance with CPLR 5529, and

It is further ORDERED that petitioner-respondent submit ten copies of his brief to the Court, together with proof of service, on or before December 6, 2017, and the Clerk is directed to accept said briefs for filing.
