ORDER

This case is set for trial at the Court's Los Angeles, California, trial session commencing May 22, 2023. On April 28, 2023, respondent filed a Status Report stating that the Internal Revenue Service Independent Office of Appeals (Appeals) is working with petitioners to negotiate a settlement. According to respondent, the parties request additional time for petitioners to obtain and send Appeals substantiation documents.

Additionally, the Court has reviewed the record in this case. Our review indicates that the record does not contain a complete copy of the notice of deficiency issued to petitioners and upon which this case is based.

Upon due consideration, it is

ORDERED that this case is stricken from the above-referenced trial session, and the parties are excused from appearing at the calendar call on May 22, 2023. It is further

ORDERED that, on or before June 9, 2023, respondent shall file a response to this Order and attach thereto a copy of the notice of deficiency issued to petitioners upon which this case is based. It is further

ORDERED that jurisdiction of this case is retained by the undersigned.
