ORDER

Peter J. Panuthos Special Trial Judge

This case was called and recalled from the calendar for the Trial Session of the Court at New York, New York on November 1, 2021. Petitioner Gabriela Taciak appeared and was heard. There was no appearance by or on behalf of intervenor Konstantinos Stathakis. Counsel for respondent appeared and made an oral motion to dismiss intervenor for lack of prosecution. After consulting with volunteer attorneys, petitioner reached a settlement with respondent which respondent read into the record.

Upon due consideration and for cause more fully appearing in the transcripts of the proceedings, it is

ORDERED that respondent's oral motion is granted and this case is dismissed for lack of prosecution as to intervenor, Konstantinos Stathakis. It is further

ORDERED that the caption of this case is amended to read "Gabriela Taciak, Petitioner v. Commissioner of Internal Revenue, Respondent." It is further

ORDERED that petitioner and respondent are directed, on or before January 7, 2022, to submit to the Court signed decision documents or, in the alternative, to file status report(s) (joint or separate) advising the Court as to the then present status of this case.
