Petitioner's "Verified Motion to Accept as Timely Filed the Petitioner/Appellee's Notice to Invoke Discretionary Jurisdiction" has been treated as a motion for reinstatement of this case, which was dismissed as untimely by this Court's order dated October 26, 2009. Upon review of the responses to this Court's subsequent order dated April 6, 2010, and petitioner's reply thereto, the motion for reinstatement is hereby denied.

LEWIS, CANADY, POLSTON, and PERRY, JJ., concur.

PARIENTE and LABARGA, JJ., would grant.

QUINCE, C.J., would appoint a senior judge to act as a commissioner.
