This case is calendared for trial at the Court's October 31, 2022, Houston, Texas Trial Session.
On October 12, 2022, docket entry 13, respondent filed a Motion to Dismiss for Lack of Prosecution. On October 26, 2022, docket entry 16, petitioner filed an Objection to Motion to Dismiss for Lack of Prosecution.
On October 28, 2022, docket entry 17, respondent filed a Motion to Remand. Respondent's counsel contacted petitioner's Power of Attorney and the Power of Attorney represented that petitioner does not object to the granting of this motion.
After due consideration, and for cause, it is
ORDERED that jurisdiction of this case is retained by this Division of the Court until further notice. It is further
ORDERED that this case is stricken for trial from the October 31, 2022, Houston, Texas Trial Session, and this case is continued. It is further
ORDERED that respondent's Motion to Dismiss for Lack of Prosecution, filed October 12, 2022, docket entry 13, is taken under advisement. It is further
ORDERED that respondent's Motion to Remand, filed October 28, 2022, docket entry 17, is granted, and this case is remanded to Respondent's IRS Office of Appeals. It is further
ORDERED that respondent shall offer petitioner an administrative hearing at respondent's Appeals Office located closest to petitioner's residence (or at such other place as may be mutually agreed upon) at a reasonable and mutually agreed upon date and time, but no later than January 11, 2023. It is further
ORDERED that, on or before February 10, 2023, the parties shall file a Supplemental Notice of Determination, or a Joint Status Report with the Court as to the then-present status of this case.
