NOTICE TO ALL POTENTIAL CLAIMANTS
As the owner of a 2018 Regal 29 OBX named Miss Madison bearing HIN RGMW117D838 (the “Vessel”)-and pursuant to 46 U.S.C § 30501, et seq., and Supplemental Rule F of the Federal Rules of Civil Procedure- SWEETWATER LIFESTYLE, LLC, filed a complaint on September 14, 2022, in the United States District Court for the Middle District of Florida seeking exoneration from, or limitation of, any liability concerning any and all personal injury, property damage, destruction, or other losses arising out of or related to a parasailing incident with the vessel on or about March 14, 2022, in the navigable waters of the United States near Estero Bay in Lee County, as more fully described in the complaint. The court has accepted an Ad Interim Stipulation for Costs and Value as interim security for all claims against plaintiff and the vessel. Pursuant to 46 U.S.C. § 30511(c), “all claims and proceedings against the owner related to the matter in question shall cease.”
By November 18, 2022, all persons or entities claiming damage for any and all loss, destruction, injuries, and/or death allegedly as a result of the occurrences and happenings recited in the complaint must file their respective claims with the clerk of this court and serve copies thereof on plaintiff counsel. By the same date, all persons or entities presenting claims and desiring to contest the allegations of the complaint must file an answer to the complaint in this court and must serve copies thereof on plaintiff counsel or be defaulted.
