MEMORANDUM OPINION


This is an appeal from a judgment signed September 30, 2004. The clerk's record was filed on April 4, 2005, and a supplemental clerk's record was filed November 15, 2005. The reporter's record was filed October 10, 2005. No brief was filed.

On January 24, 2006, appellee filed a motion to dismiss the appeal for want of prosecution. See TEX. R. APP. P. 42.3(b). On February 13, 2006, appellant filed a response to the motion to dismiss and to extend time to file appellant's brief until February 17, 2006.

No brief has been filed. The motion for extension of time to file a brief is denied as moot. Appellee's motion to dismiss is granted.

Accordingly, the appeal is ordered dismissed.
