Roderick SUTTON, Appellant v. The STATE of Texas, Appellee

From the 25th Judicial District Court, Guadalupe County, Texas

Trial Court No. 12-0275-CR

Charles Ramsay, Judge Presiding

ORDER

Appellant has filed leave to file a supplemental brief. Appellant desires to file a supplemental brief in order to raise an issue he believes was previously foreclosed, but may now be raised based on a September 25, 2013 decision from the Texas Court of Criminal Appeals. Accordingly, we GRANT appellant's motion for leave to file a supplemental brief. We ORDER appellant to file his supplemental brief on or before October 24, 2013. Appellant is advised that in the supplemental brief he may raise ONLY a complaint about the denial of the motion to suppress. The State is advised that if it wishes to file a responsive brief to the supplemental brief, it must do so within twenty days after the date the appellant's supplemental brief is filed.
