This case was calendared for trial at the Court's New York City, New York, trial session, which was scheduled to begin June 13, 2022. On May 12, 2022, respondent filed a Motion for Continuance, apprising the Court that a continuance would allow petitioner an opportunity to work with the newly assigned Appeals Officer to exchange information, clarify the underlying facts, and work towards a settlement. On May 13, 2022, the Court served an Order on the parties, granting the continuance, striking the case from the calendar and giving the parties until July 13, 2022 to file either a signed decision document or file a status report apprising the Court of the then-present status of the case. On July 11, 2022, respondent filed a status report indicating that the parties are currently working together to exchange information and documents to resolve the issues raised in the Notice of Deficiency. On July 12, 2022, the Court served an Order on the parties, granting them until August 12, 2022 to file either a signed decision document or file a status report apprising the Court of the then-present status of the case. On August 11, 2022, respondent filed a Status Report apprising the Court that since the filing of the prior status report, petitioner has not returned any phone calls to either the Appeals Officer or respondent.
Upon due consideration, it is hereby
ORDERED that, on or before September 12, 2022, the parties shall submit to the Court either a stipulated decision or file a joint report (or separate reports, if preferred) regarding the then-present status of this case. 1
