MEMORANDUM OPINION


The Court has before it the parties' January 30, 2006 "joint motion to dismiss appeal and remand to trial court with instructions to vacate judgment pursuant to settlement agreement." The motion asserts that the parties have entered into an agreement to settle this matter and want this Court to remand the case to the trial court with instructions to vacate the judgment and enter judgment consistent with the parties' agreement. We GRANT the motion to the extent that we VACATE the trial court's August 10, 2005 judgment without reference to the merits and REMAND this case to the trial court with instructions to enter judgment consistent with the parties' agreement. See Tex.R.App.P. 42.1(a)(2)(B).
