MEMORANDUM OPINION


Before the Court is the parties' February 4, 2004 "agreed motion to vacate judgment and to dismiss with prejudice." The parties move the Court to "vacate the trial court's judgment and dismiss this action with prejudice" and state that they have "compromised and settled all issues in dispute. . . ." The motion is signed by counsel for all parties. The parties' agreed motion is GRANTED. The trial court's August 29, 2003 final judgment is VACATED, without reference to the merits, and this case is DISMISSED, with prejudice. See Tex.R.App.P. 42.1(a)(2), 43.2(e).
