ORDER OF ABATEMENT

PER CURIAM.

Appellants Sunray Marketing LLC, Sunray Terminal, LLC, Jeff Kirby, Individually, and Jane G. Helm, Individually appeal the trial court's order granting appellee, Petro Source Partners, LLC's, motion for summary judgment.

After oral argument of this case on February 15, 2023, this Court inquired as to whether the parties had attempted to mediate their issues. The parties responded that they had not. This Court asked the parties to confer as to whether they would agree to mediation.

On February 21, 2023, appellants submitted a letter explaining that the parties had conferred. The parties agreed to attempt an informal resolution; failing an informal resolution, the parties agreed to formal mediation. In the letter, the parties jointly requested that the appeal be abated pending these attempts at resolution.

The Court, having considered the letter and requested motion to abate, is of the opinion that the request should be granted. Accordingly, we GRANT the request, ABATE this appeal, and remove this case from the Court's active docket.
