We REINSTATE this appeal, which we abated to allow the trial court an opportunity to sign an amended order unambiguously reflecting the court's ruling on appellants' objection to appellee's expert report. The trial court was to sign the amended order no later than January 8, 2024, and a supplemental clerk's record containing a copy of the order was to be filed no later than January 12, 2024. The trial court's online docket reflects the trial court signed an order denying the objection on January 8, 2024, but to date, a supplemental clerk's record with a copy of that order has not been filed.
Accordingly, we ORDER Dallas County Clerk John F. Warren to file a supplemental clerk's record containing a copy of the trial court's January 8th order no later than February 12, 2024.
We note the parties previously informed the Court that they were scheduled for mediation in January, and the trial court's online docket includes a letter from the mediator reflecting the parties have settled. Accordingly, we ORDER a motion to dismiss or status report be filed no later than February 20, 2024.
We DIRECT the Clerk of the Court to send a copy of this order to Mr. Warren and the parties.
