SUMMIT LTC MANAGEMENT, LLC AND SUMMIT LTC DALLAS, LLC, Appellants v. ELLIS FORD, INDIVIDUALLY, AND AS REPRESENTATIVE OF THE ESTATE OF AGNES FORD, Appellee
On Appeal from the County Court at Law No. 4 Dallas County, Texas Trial Court Cause No. CC-23-03064-D
Before Chief Justice Burns, Justice Pedersen, III, and Justice Goldstein
ORDER
ROBERT D. BURNS, III CHIEF JUSTICE
This interlocutory appeal follows the trial court's September 18, 2023 ruling on appellants' objection to appellee's expert report. The objection also sought dismissal of the underlying health care liability claims against appellants. See TEX. CIV. PRAC. &REM. CODE ANN. §§ 51.014(A)(9), 74.351(B).
The record reflects the trial court stated on the record that it was overruling the objection and had changed the proposed order granting the objection accordingly. The order the court signed, however, overrules but also sustains the objection.
We ORDER the trial court to sign an amended order that unambiguously reflects the court's ruling no later than December 8, 2023. We further ORDER Dallas County Clerk John F. Warren to file a supplemental clerk's record containing a copy of the amended order no later than December 12, 2023.
We DIRECT the Clerk of the Court to send a copy of this order to the Honorable Dianne K. Jones, Presiding Judge of County Court at Law No. 4; Mr. Warren; and the parties.
We SUSPEND all pending deadlines and ABATE the appeal to allow the trial court an opportunity to comply with this order. The Court will reinstate the appeal and reset all applicable deadlines no later than December 18, 2023.
