The clerk's record was filed on July 10, 2024. A supplemental clerk's record was filed on August 9, 2024. The clerk's record contains no statement of inability to afford payment of court costs. Accordingly, appellants are responsible for payment of costs on appeal.
The reporter's record was due on June 28, 2024. On June 27, 2024, the court reporter advised that appellants had made no request for preparation of the reporter's record and had not paid for the reporter's record. A notice issued on July 9, 2024, stating that the Court might require appellants to file their brief without a reporter's record and consider and decide the appeal on issues not requiring a reporter's record for decision. See Tex. R. App. P. 37.3(c). Appellants filed no response to the Court's notice and no reporter's record was filed.
Because appellants have not made arrangements for the filing of the reporter's record, the Court will consider and decide those issues or points that do not require a reporter's record for a decision. See Tex. R. App. P. 37.3(c).
On August 8, 2024, appellants' counsel filed a motion for extension of time to file appellants' brief, asking that we extend the deadline to October 7, 2024. The extension is granted and appellants' brief is due on October 7, 2024 Failure to file a brief may result in dismissal of the appeal.
