This amended decision is being filed to correct the wording of a sentence that appears on the second page.

The last sentence in the first full paragraph on page two should read as follows:

The remaining parties appeared before the Court again on November l9, 2009, at which point the parties agreed that the case presents only questions of law and that the facts are not in dispute.
