Sullivan v. State

District Court of Appeal of Florida, Second District
Jan 9, 1991
572 So. 2d 564 (Fla. Dist. Ct. App. 1991)

Opinion

No. 90-00187.

January 9, 1991.

Appeal from the Circuit Court for Polk County; Charles A. Davis, Jr., Judge.

James Marion Moorman, Public Defender, and Stephen Krosschell, Asst. Public Defender, Bartow, for appellant.

Robert A. Butterworth, Atty. Gen., Tallahassee, and Wendy Buffington, Asst. Atty. Gen., Tampa, for appellee.

We find no error in the trial judge's denial of the appellant's motion to suppress. Accordingly, we affirm the appellant's judgment and sentences but strike court costs and attorney's fees without prejudice to the state to seek reimposition after proper notice and opportunity to be heard.

DANAHY, A.C.J., and FRANK and ALTENBERND, JJ., concur.
