MUNICIPAL COURTS, § 69assessment of damages without jury. Where plaintiff, as assignee, brought suit to revive a money judgment entered by confession, and defendant filed a defense and jury demand but failed to appear on day set for hearing on plaintiff's motion to strike defendant's amended statement of defense and counterclaim, and motion was sustained, municipal court of Chicago was authorized in defendant's absence to assess damages without a jury (Rules of the Municipal Court of Chicago, Rule 68).

Appeal from the Municipal Court of Chicago; the Hon. CECIL C. SMITH, Judge, presiding.

Judgment affirmed. Heard in the third division, first district, this court at the October term, 1948.
