ORDER

This case was scheduled for trial at the Court's upcoming trial session in St. Louis, beginning October 24, 2022. However, during a telephone conference held October 18, 2022, the counsel for the Commissioner informed the Court that the IRS has decided to accept the liability as reported by petitioner on his late-filed return. The parties therefore expect to file a proposed stipulated decision.

Since it appears that no trial will be necessary in this case, it is

ORDERED that this case is continued and is stricken from the calendar of the upcoming St. Louis session, that the case will not be called at that session, and that the parties need not appear on October 24, 2022. It is further

ORDERED that the judge signing this order retains jurisdiction over this case. It is further

ORDERED that, no later than November 21, 2022, the parties shall file a proposed stipulated decision or another appropriate filing.
