Suffolk County Builders Ass'n v. Town of Islip

Appellate Division of the Supreme Court of New York, Second Department
Jan 25, 1971
36 A.D.2d 541 (N.Y. App. Div. 1971)

Opinion

January 25, 1971

In consolidated actions inter alia for judgment declaring that certain conditions imposed for the granting of building permits are unlawful and for injunctive relief, plaintiffs appeal from so much of a judgment of the Supreme Court, Suffolk County, entered January 8, 1970, after a nonjury trial, as, after granting relief to plaintiffs other than Suffolk County Builders Association, Inc., with respect to the land described in the complaints, (1) refused to consider "the class action" referred to in the complaints, (2) failed to make certain general declarations, (3) limited the relief granted to the land described in the complaints and (4) dismissed the complaint as to plaintiff Suffolk County Builders Association, Inc. Appeal dismissed, without costs. Plaintiff Suffolk County Builders Association, Inc. has no standing to appeal and there is no justiciable controversy for determination by this court as to the other plaintiffs, since the judgment accorded them all the relief they requested. Munder, Acting P.J., Martuscello, Shapiro, Brennan and Benjamin, JJ., concur.
