DECISION & ORDER ON MOTION

Appeal from an order of the Supreme Court, Dutchess County, dated June 5, 2020, which was dismissed by decision and order on motion of this Court dated March 31, 2021, on the ground that no appeal lies from an order entered upon the consent of the appealing party. Motion by the appellant to recall and vacate the decision and order on motion of this Court dated March 31, 2021, and for leave to appeal from the order dated June 5, 2020.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is denied.
