Suarez v. State

District Court of Appeal of Florida, Third District
Aug 19, 1998
715 So. 2d 1127 (Fla. Dist. Ct. App. 1998)

Opinion

No. 98-1325.

August 19, 1998.

An appeal under Fla. R. App. P. 9.140(i) from the Circuit Court for Dade County; Jerald Bagley, Judge.

Rodolfo Suarez, in proper person.

Robert A. Butterworth, Attorney General, and Christine E. Zahralban, Assistant Attorney General, for appellee.

Before COPE, GERSTEN and SHEVIN JJ.

Rodolfo Suarez appeals an order denying his motion to correct his sentences. The State concedes that there is a discrepancy between the credit for time served, as reflected on the courts docket sheet, and the credit actually appearing on the sentencing order. We reverse the order under review and remand for a hearing to ascertain the correct amount of credit for time served.

Reversed and remanded.
