ORDER
PER CURIAM
On November 6, 2023, the Clerk of this Court notified Appellant that no designation of record or financial arrangements for the reporter's record had been made in this cause. Our letter directed Appellant to notify this Court by November 16, 2023 as to what arrangements had been made for the reporter's record to be prepared in this cause. On November 21, 2023, the Court Reporter again notified this Court that no arrangements have been made for the record. The Reporter's notice to this Court also requested an additional 30 day extension to prepare the record, after payment has been received.
Appellant responded to our letter with a motion for extension to file the appellate brief. The brief was due September 17, 2023. Appellant's motion states that he is “attempting to gather funds to pay for the Reporter Record.” Appellant requests an extension of 88 days, until December 14, 2023, to file his appellate brief. Appellant's motion is DENIED.
We ORDER Appellant to provide written proof to this Court by December 2, 2023 that the Appellant has requested, in writing, the necessary portions of the reporter's record, and made financial arrangements for its completion. The Appellant's written request must designate the portions of the proceedings and the exhibits to be included. TEX. R. APP. P. 34.6(b)(1). The record must be filed no later than thirty days after the date Appellant's written proof is filed with this Court.
If Appellant fails to respond to this order within the time provided, Appellant's brief will be due 30 days from the date of this order, and the Court will consider only those issues or points raised in Appellant's brief that do not require a reporter's record for a decision. See TEX. R. APP. P. 37.3(C).
