ORDER OF DISMISSAL AND DECISION

DANIEL A. GUY, JR. SPECIAL TRIAL JUDGE

On June 8, 2021, the Court issued an Order striking this case from the September 13, 2021, Los Angeles, California trial session and remanded it to respondent's Office of Appeals for further consideration. On October 14, 2021, respondent filed a status report indicating that petitioner failed to cooperate during the remand proceedings.

Petitioner failed to respond to the Court's attempts to contact him in an effort to arrange a conference call. On October 26, 2021, the Court issued an Order to Show Cause directing petitioner to explain, in writing, why the Court should not dismiss this case for failure to properly prosecute. Petitioner failed to respond to the Court's Order. The Court can only conclude that petitioner is not interested in prosecuting this case.

Upon due consideration, it is

ORDERED that the Court's Order to Show Cause dated October 26, 2021, is made absolute in that this case is dismissed for failure to properly prosecute. It is further

ORDERED AND DECIDED that the notice of determination concerning collection actions, dated October 15, 2020, upon which this case is based, is sustained.
