An appeal having been taken to this Court from an order of the Supreme Court, Bronx County, entered on or about April 07, 2021, and the appeal having been perfected, And defendant-appellant, pro se, having moved for this Court to take judicial notice that the plaintiff's suggested representative has failed to move, pursuant to CPLR 1015[a] and 1021, to be substituted in the action for plaintiff who passed away on March 10, 2010, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is denied.
