Stranberg v. Wynne

Court of Appeals of Texas, Fifth District, Dallas
Aug 22, 2003
No. 05-03-00218-CV (Tex. App. Aug. 22, 2003)

Opinion

No. 05-03-00218-CV

Opinion Filed August 22, 2003

On Appeal from the County Court at Law No. 1, Grayson County, Texas, Trial Court Cause No. 2002-1-181CV

DISMISS

Before Justices MORRIS, WRIGHT, and MOSELEY

MEMORANDUM OPINION

The Court filed the May 7, 2003 letter of the mediator informing the Court that mediation was successful and that the case had been settled. The letter stated that attorneys were "in the process of drafting final documents to be submitted to the Court in the near future." However, the Court has not received any settlement documents, with a motion to dismiss, from the parties. See Tex.R.App.P. 42.1(a).

In a letter dated July 25, 2003, the parties were directed to file, within ten (10) days, a motion to dismiss pursuant to their settlement agreement or a status letter regarding this appeal. The parties were informed that failure to file either a motion to dismiss or a status letter would result in this appeal being dismissed for want of prosecution without further notice from the Court. The parties have failed to respond.

On the Court's own motion, this appeal is DISMISSED for want of prosecution. See Tex.R.App.P. 42.3(b), (c).
