NO. 14-15-00801-CR
06-09-2016
On Appeal from the 174th District Court Harris County, Texas
Trial Court Cause No. 1450199
ORDER
Appellant is represented by appointed counsel, Patrick McCann. Appellant's brief was originally due February 8, 2016. We have granted a total of at least 90 days to file appellant's brief until May 9, 2016. When we granted the last extension, we noted that no further extensions would be granted absent exceptional circumstances.
On May 17, 2016, appellant's brief was filed. In addition to the brief, a motion for extension of time to file the brief and a motion to file an oversized brief were filed.
We deny both counsel's motion for extension of time to file his brief and his motion to file an oversized brief and issue the following orders.
We order the appellant's brief, filed on May 17, 2016, stricken. We further order Patrick McCann to file a compliant brief with the clerk of this court on or before June 30, 2016. If counsel does not timely file appellant's brief as ordered, the court will issue an order abating the appeal and directing the trial court to conduct a hearing to determine the reason for the failure to file the brief and the consideration of sanctions, appointment of new counsel, or other appropriate relief.
PER CURIAM Panel consists of Justices Busby, Donovan, and Wise.
