ORDER


This matter came on for hearing on April 15, 2003, before the Court pursuant to defendants' Motion to Compel, defendants' Motion for Summary Judgment and plaintiff's Motion to Substitute Counsel. Plaintiff was represented by attorney Dana M. Facemyer. Defendants were represented by attorney Peter Stirba. The Court, having read the parties' memoranda and the affidavits submitted in support and in opposition to the parties' motions, and being fully advised in the premises, hereby ORDERS as follows:

1. Defendants' Motion to Compel is hereby DENIED on the grounds that it is moot;

2. Plaintiff's Motion to Substitute Counsel is hereby DENIED;

3. Defendant's Motion for Summary Judgment is hereby GRANTED with respect to plaintiff's First Claim for Relief against Pleasant Grove City and the Pleasant Grove Police Department, Second Claim for Relief against all defendants, and Fourth Claim for Relief against all defendants;

2. Defendants' Motion for Summary Judgment is hereby DENIED with respect to plaintiff's Third Claim for Relief.
