BEFORE: PETTIGREW, McDONALD, AMD CRAIN, JJ.

WRIT GRANTED. The district court's September 25, 2013 Order that denied the Motion and Order for Jury Trial and Order to Waive Prepayment of Jury Costs filed by Relator/Defendant, State of Louisiana, through the Department of Transportation and Development, is hereby REVERSED. This case is remanded to the district court with instructions that the matter be tried before a civil jury without any requirement that the State of Louisiana, through the Department of Transportation and Development, post a cash deposit or prepay any jury costs. La. R.S. 13;5105(E).
