ORDER DENYING WITHOUT PREJUDICE REQUEST FOR ATTORNEY'S FEES AND COSTS FILED ON NOVEMBER 10, 2008
Upon consideration of Plaintiffs-Appellees Robert J. Stone and Judy S. Stone's Request for Attorney's Fees and Costs and Declaration of Counsel filed on November 10, 2008, and the attachments thereto, the request is denied without prejudice for failure to adequately document their request. The attached invoices list multiple attorneys at different hourly rates which appear to be billed at one attorney's rate. There is no receipt attached for transcript costs and no justification or description for requested copying costs. The total amount requested is more than the total amount of the attached invoices.
Therefore, IT IS HEREBY ORDERED that the Request for Attorney's Fees and Costs is denied without prejudice to a subsequent request that substantially complies with Hawai'i Rules of Appellate Procedure Rule 39 and Form 7a.
