February 21, 1939.

Motion for an appeal from the Madison Circuit Court.

Judgment in suit to settle estate of John Fife, Sr., disallowing defendant's claim on a note for $400, subject to a credit of $228, and his claim of ownership of a pair of mules valued at $160, and a one-half interest in certain farm machinery valued at $100. Defendant's statement of appeal requesting clerk of Court of Appeals to grant appeal and issue summons to Madison County treated as a motion for an appeal under Section 950-3, Ky. Statutes.
