RICHARD M. STONE & GENA B. STONE, Petitioners v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Eunkyong Choi, Special Trial Judge.

This case is currently calendared for trial at the Court's Atlanta, Georgia, trial session, which is scheduled to begin September 26, 2022. On August 19, 2022, respondent filed a Status Report informing the Court that respondent intends to mail petitioners a proposed settlement with a reduced deficiency and no penalty owed; however, counsel does not anticipate cooperation or a response from petitioners as they have been non-responsive. In the event petitioners remain non-responsive, counsel anticipates filing a motion for entry of decision with a reduced deficiency and no penalty due.

Upon due consideration, it is hereby

ORDERED that, on or before October 7, 2022, the parties shall submit to the Court a stipulated decision or file a joint report (or separate reports, if preferred) regarding the then-present status of this case. It is further

ORDERED that this case is stricken from the above-referenced remote calendar, and the parties are excused from appearing at calendar call. It is further

ORDERED that this case is continued. It is further

ORDERED that jurisdiction is retained by the undersigned.
