Decision Pursuant to Rule 1:28.

So much of the judgment as pertains to the steps is vacated. So much of the judgment as declares a right of foot passage in the inhabitants of the town shall be modified to include members of the general public. The judgment dated November 3, 2005, is remanded for further proceedings regarding the steps, consistent with the memorandum and order of the Appeals Court.
