Present — Peck, P.J., Dore, Cohn, Shientag and Bergan, JJ.


Order unanimously modified by eliminating the provision for oral cross-examination and oral redirect examination of the witness and, as so modified, affirmed, with $10 costs and disbursements to appellant. Under the circumstances of this case we feel that written interrogatories will suffice. Settle order on notice.
