Stokes v. State

Supreme Court of Florida
Oct 8, 2009
20 So. 3d 849 (Fla. 2009)

Opinion

No. SC09-1836.

October 8, 2009.

Lower Tribunal No(s). 1D97-2934, 1D09-4167, 94-5431, 96-729, 96-730.

Petitioner's "Amended Petition Accompanied by an Appendix Containing Copy of the Order for Which Belated Appeal is Sought" is being treated as a petition for belated discretionary review. The petition is hereby dismissed for lack of jurisdiction, as this Court would not have had jurisdiction even if petitioner had filed a timely notice to invoke this Court's discretionary review of the subject district court decision in Stokes v. State, 728 So. 2d 212 (Fla. 1st DCA 1998) (DONo. 1D97-2934) (table). See Grate v. State, 750 So. 2d 625 (Fla. 1999), and Jenkins v. State, 385 So. 2d 1356 (Fla. 1980). No motion for rehearing will be entertained by the Court.
