ERIC STEWART, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 292nd Judicial District Court Dallas County, Texas Trial Court Cause No. F22-76697

ORDER

NANCY KENNEDY JUSTICE

We REINSTATE this appeal.

We abated this appeal for the trial court to make findings and recommendations concerning appellant's appointed counsel Kristen Brown's failure to file appellant's brief. The trial court found Ms. Brown's failure to file the brief was "due to personal and extenuating circumstances involving medical issues with an immediate family member. The delay was not intentional." The trial court recommended granting Ms. Brown an extension of 45 days from March 11, 2024.

We accept the trial court's findings and recommendations, and ORDER Ms. Brown to file appellant's brief on or before APRIL 25, 2024. If the brief is not filed by that date, this Court may order Ms. Brown removed from representing appellant and order the trial court to appoint new counsel for appellant.
