RICKY LEE STEVENSON, II, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 199th Judicial District Court Collin County, Texas Trial Court Cause No. 199-81736-2022

ORDER

BONNIE LEE GOLDSTEIN PRESIDING JUSTICE.

Appellant's brief filed August 28, 2023, and appellant's amended brief filed September 6, 2023, state the name of a minor at the time of the offense, namely, the complainant, who the record shows was seventeen years old at the time of the offense. Texas Rule of Appellate Procedure 9.10(a) provides that sensitive data that may not be included in papers filed with the Court include "the name of any person who was a minor at the time the offense was committed." TEX. R. APP. P. 9.10(A)(3). ACCORDINGLY, WE STRIKE appellant's brief filed August 28, 2023, and the amended brief filed September 6, 2023, and we ORDER appellant to file on or before NOVEMBER 27, 2023, an amended brief referring to any person who was a minor at the time of the offense with initials or generic terms. As this case is set for submission with oral argument on November 28, 2023, time is of the essence in the filing of the amended brief. Submission of the appeal will not be continued due to appellant's failure to timely file the amended brief.
