Present — Martin, P.J., Townley, Glennon, Untermyer and Dore, JJ.; Townley and Untermyer, JJ., dissent and vote to reverse and grant the motion to dismiss the complaint on the ground of insufficiency in law.


Order, so far as appealed from, affirmed, with twenty dollars costs and disbursements to the respondent, with leave to the defendants-appellants to answer within ten days after service of a copy of order with notice of entry thereof, on payment of said costs. No opinion.
