DECISION & ORDER ON MOTION

Motion by appellant-respondent, in effect, to extend the time to serve an amended notice of appeal from a decision of the Civil Court of the City of New York, Kings County, dated November 12, 2013, or, in the alternative, to deem the notice of appeal premature pursuant to CPLR 5520 (c), or for leave to reargue respondent-appellant's cross motion to dismiss the appeal which was determined by decision and order on motion of this court dated March 24, 2015, or for leave to appeal to the Appellate Division from this court's decision and order on motion.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied (see CPLR 5016 [a]; CCA 1702). Appellant-respondent's remedy, if he be so advised, is to enter a judgment and appeal therefrom.
