ORDER

Respondent has appealed the Administrative Law Judge's decision not to recuse. Based upon our de novo review of the record, the Commission dismisses this appeal, because the Judge's decision not to recuse is not a final, appealable order. It is also premature for the Commission to consider a motion for recusal of the Commissioners because this matter is currently not before the Commission on appeal on the substantive issues. See Samuels Hide Metal Co. v. Griffin, 23 Ark. App. 3 739 S.W.2d 698 (1987); and Cooper Industrial Products v. Meadows, 269 Ark. 966, 601 S.W.2d 275 (Ark.App. 1980).

Accordingly, the respondent's appeal of the Administrative Law Judge's decision not to recuse is hereby dismissed.

IT IS SO ORDERED.
