ORDER
This matter arises on the following:
(1) Plaintiff's Motion for Initial Filing of Motion to Amend Complaint and Exhibits Under Seal and Request for Order Unsealing Same [Doc. # 49, filed 4/14/2010] (the "Motion to Unseal");
(2) Plaintiff's Motion to Amend Complaint to Assert Claim for Exemplary Damages [Doc. # 52, filed 4/14/2010] (the "Motion to Amend");
(3) Plaintiff's Unopposed Motion for Limited Extension of the Discovery Cut-Off [Doc. # 55, filed 4/30/2010] ("Plaintiff's Motion for Extension");
(4) Defendants' Unopposed Motion for Limited Extension of the Discovery Cut-Off [Doc. # 57, filed 4/30/2010] ("Defendants' Motion for Extension"); and
(5) Defendants' oral motion to stay the effect of my order.
I held a hearing on the motions this morning and made rulings on the record, which are incorporated here. In summary and for the reasons stated on the record:
IT IS ORDERED that the Motion to Unseal [Doc. # 49] is GRANTED. The Motion to Amend and all of its attachments and exhibits shall be placed in the case file and open to public inspection.
IT IS FURTHER ORDERED that the Motion to Amend [Doc. # 52] is GRANTED. The Clerk of the Court is directed to accept for filing the Amended Complaint [Doc. # 51-1].
IT IS FURTHER ORDERED that the Plaintiff's Motion for Extension [Doc. # 55] and the Defendants' Motion for Extension [Doc. # 57] are GRANTED. The discovery cut-off is extended to and including May 31, 2010, solely to allow the following discovery to be taken:
(a) The Rule 30(b)(6) deposition of Spotlight, Inc.;
(b) The deposition of Alden Glove;
(c) Service of a subpoena to produce the hard drive described in ¶ 4(b) of Defendants' Motion for Extension;
(d) The deposition of the custodian of records of Hitachi; and
(e) The deposition of Codie Marcell.
IT IS FURTHER ORDERED that the defendants' oral motion to stay this order pending review by the district judge is DENIED.
