ORDER

This matter having come before the Court on non-party victim E.A.’s application for emergent relief filed pursuant to Rule 2:9-8, seeking, among other forms of relief, leave to appeal from an order of the trial court entered August 24, 2023, which dismissed E.A.’s emergent motion for a detention hearing in the above-captioned matter; and

A single justice of the Court having referred the application to the full Court for its consideration; and

The Court having entered an order on September 11, 2023, granting leave to appeal and setting a peremptory briefing schedule on appeal; and

E.A. having failed to file an appellant’s brief as of the date of this order;

It is ORDERED that the order granting leave to appeal is vacated, and the appeal (A-5-23) is dismissed, with prejudice, for lack of prosecution.
