Appellant having moved to expedite oral argument of the appeal taken from an order of the Supreme Court entered in the Office of the Clerk of the County of Chautauqua on May 6, 2011,

Now, upon reading and filing the affirmation of Mark C. Davison, Esq., dated October 6, 2011, the notice of motion with proof of service thereof, and the affirmation of Laura Etlinger, Esq., dated October 14, 2011, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted, and the appeal is removed from the calendar for the term of this Court commencing February 21, 2012, and is added to the Court's day calendar for January 18, 2012.
