STATE OF LOUISIANA v. RODNEY L. WHITE


In Re: Rodney L. White, applying for supervisory writs, 19th Judicial District Court, Parish of East Baton Rouge, No. 02-99-0127. BEFORE: WHIPPLE, C.J., WELCH AND HIGGINBOTHAM, JJ.

WRIT DENIED. This court takes judicial notice of the documents provided in 2014 KW 1609. The documents show the grand jury proceedings in this case were not transcribed. Therefore, the State cannot provide a transcript that it does not have in its possession. Furthermore, La. Code Crim. P. art. 434 prohibits the divulgence of testimony and other matters occurring during grand jury meetings. See State v. Gutweiler, 2006-2596 (La. 4/8/08), 979 So.2d 469, 479.
